This website is operated by Crème DU CRIME. Throughout the site, the terms "we", "us" and "our" refer to Crème DU CRIME. We publish and sell printed books documenting the history of organized crime. We offer this website, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services.
Any new features or tools added to the current store are also subject to these Terms of Service. You can review the most current version at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates to our website. Your continued use of the site following the posting of any changes constitutes acceptance of those changes.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your jurisdiction, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.
Please note that our books document violent crime and include archival photographs and case material that some readers will find disturbing. They are published as documentary works for an adult readership.
You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Services, violate any laws in your jurisdiction, including copyright laws.
If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
SECTION 2 - OUR BOOKS
Our books are printed to order. No copy sits in a warehouse waiting for a buyer, which means each order is manufactured after it is placed.
We have made every effort to display our books as accurately as possible, but we cannot guarantee that your screen will render colors, paper tone or finish exactly as they appear in the printed object. Our titles reproduce archival photographs, many of them decades old and recovered from press files, court records and law enforcement material. The condition of the original source is preserved rather than corrected, so grain, contrast and damage visible in a historical image are part of the record and are not printing defects.
Minor variation in trim, binding alignment and color between print runs is normal in print-to-order manufacturing and is not considered a defect.
Book specifications, page counts and availability are subject to change without notice. We reserve the right to discontinue any title at any time. Editions are identified on the copyright page, and a later edition may differ from the one described at the time of your purchase.
SECTION 3 - ORDERS
Your order is an offer to buy. We reserve the right to refuse or cancel any order, and to limit or cancel quantities purchased per person, per household or per order. In the event we change or cancel an order, we will attempt to notify you at the email address provided at the time of purchase.
Because every book is printed to order, orders can be cancelled or amended within 24 hours of purchase, before the book enters production. After production begins, the order cannot be cancelled or modified, and the Refund Policy applies instead.
Our books are sold for personal use. You agree not to purchase them for commercial resale or systematic redistribution without our prior written consent.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your email and shipping address so that we can complete your order.
SECTION 4 - PRICES AND BILLING
Prices for our books are subject to change without notice. The price that applies to your order is the price displayed at the time the order is placed.
Unless stated otherwise, prices exclude taxes, duties and shipping charges, which are calculated at checkout or, in the case of import duties, assessed by your local authorities on delivery.
Promotions, discount codes and offers may carry their own terms, and where those terms conflict with these Terms of Service, the promotion terms govern that purchase.
SECTION 5 - SHIPPING AND DELIVERY
Delivery estimates, production times and shipping methods are set out in our Shipping Policy, which forms part of these Terms of Service.
Estimates cover production and transit together and are estimates, not guarantees. We are not liable for delays caused by carriers, customs authorities, weather or events outside our control. Risk of loss passes to you once the parcel is handed to the carrier, subject to the replacement terms set out in our Refund Policy.
SECTION 6 - INTELLECTUAL PROPERTY
The design, typography, layout, original maps, reconstructed exhibits, editorial text and compilation of our books are the intellectual property of Crème DU CRIME and are protected by copyright. Our name, logo and trade dress are our trademarks and may not be used without written permission.
Archival photographs reproduced in our books remain the property of their respective rights holders and are used in a documentary and editorial context, with sources listed in each volume. If you believe material has been reproduced in error or without proper attribution, contact us at hello.cremeducrime@gmail.com and we will review it.
You may not reproduce, scan, distribute, resell or create derivative works from our books or from the content of this website without our prior written permission. Quoting brief passages for review, criticism, journalism or academic work is permitted with attribution.
SECTION 7 - OPTIONAL TOOLS
We may provide you with access to third-party tools which we neither monitor nor have any control or input over. You acknowledge that we provide access to such tools "as is" and "as available", without warranties or conditions of any kind. Any use by you of optional tools is entirely at your own risk, and you should review the terms on which those tools are provided by their relevant third-party providers.
SECTION 8 - THIRD-PARTY LINKS
Certain content and services available through our Services may include materials from third parties. Third-party links on this site may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not warrant or assume liability for any third-party materials or websites. Complaints, claims or questions regarding third-party products should be directed to that third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Crème DU CRIME is powered by Shopify, which enables us to provide the Services to you. Shopify processes and stores data on our behalf in connection with your use of the Services.

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. Review our Privacy Policy for details on how we, Shopify and our partners use your personal information.
SECTION 11 - FEEDBACK
If you send us ideas, suggestions, proposals or other material, whether at our request or not, you agree that we may use, edit, copy, publish and distribute it in any medium without restriction and without obligation to compensate you or keep it confidential. This does not apply to personal information, which is handled under our Privacy Policy.
We are under no obligation to maintain any comments in confidence, to pay compensation for any comments, or to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine to be unlawful, offensive, threatening, defamatory or otherwise objectionable.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to book descriptions, specifications, pricing, promotions, delivery estimates or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Services is inaccurate at any time without prior notice, including after you have submitted your order.
We undertake no obligation to update, amend or clarify information on the Services except as required by law. No specified update or refresh date applied on the Services should be taken to indicate that all information has been modified or updated.
SECTION 13 - PROHIBITED USES
In addition to other prohibitions set out in these Terms of Service, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any regulations, rules, laws or local ordinances; to infringe upon or violate our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate; to submit false or misleading information; to upload or transmit viruses or any other type of malicious code; to collect or track the personal information of others; to spam, phish, pretext, crawl or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the Services. We reserve the right to terminate your use of the Services for violating any of the prohibited uses.
SECTION 14 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site.
If in our sole judgment you fail to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. We may deny you access to our Services accordingly.
SECTION 15 - DISCLAIMER OF WARRANTIES
We do not guarantee that your use of our Services will be uninterrupted, timely, secure or error-free, or that the results obtained from the use of the Services will be accurate or reliable.
You agree that from time to time we may remove the Services for indefinite periods of time or cancel the Services at any time, without notice to you.
Except as expressly stated by us, the Services and all books delivered to you through the Services are provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement. Nothing in this section limits any statutory rights you have as a consumer, including the rights described in our Refund Policy.
SECTION 16 - LIMITATION OF LIABILITY
Our books are works of documentary history, compiled from archival and public record sources listed in each volume. They are provided for information and reference. We make no warranty that every detail of the historical record is free from error, and the books are not offered as legal, investigative or professional advice.
In no case shall Crème DU CRIME, our directors, officers, employees, affiliates, agents, contractors, suppliers or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of any of the Services or any products procured using the Services, including lost profits, lost revenue, lost savings or loss of data, whether based in contract, tort, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.
Where the exclusion or limitation of liability for consequential or incidental damages is not permitted by applicable law, our liability shall be limited to the maximum extent permitted by law.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Crème DU CRIME and our affiliates, partners, officers, directors, agents, contractors, suppliers, service providers, subcontractors and employees, from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
SECTION 18 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior agreements, communications and proposals, whether oral or written. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 21 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Spain, where Crème DU CRIME is established, without regard to conflict of law provisions.
Nothing in this section deprives you of the protection of the mandatory consumer law of the country in which you habitually reside, and consumers resident in the European Union may also bring proceedings before the courts of their own country.
